Software License Agreement

Important notice: Anhui MiMouse Technology Co., Ltd. (hereinafter referred to as "MiMouse") hereby reminds users to carefully read this "Software License Agreement" -- Users should carefully read the terms and conditions of this "Software License Agreement" (hereinafter referred to as the "Agreement"), including the exemption clauses that exempt or limit the liability of MiMouse and the restrictions on the rights of users. Please review and accept or not accept this Agreement (minors should be accompanied by their legal guardians to review the Agreement). Unless you accept the terms of this Agreement, you are not authorized to download, install or use the Software and its related services. Your installation and use will be deemed to be an acceptance of this Agreement and your agreement to be bound by the terms of this Agreement.

This "Agreement" is an agreement between the user, MiMouse and its operating partners ("partners") regarding the download, installation, use and copying of "MiMouse" software (hereinafter referred to as the "software"). This Agreement describes the rights and obligations between MiMouse and you regarding the license and use of the "Software" and related aspects. "User" or "you" refers to an individual or a single entity that obtains the software license and/or software product through the means provided by MiMouse to obtain software authorization.

1. [Intellectual Property Rights Statement]

1.1 The "Software" is developed by MiMouse. All copyrights and other intellectual property rights of the Software, as well as all information related to the Software, including but not limited to: text expressions and their combinations, icons, graphics, charts, colors, interface design, layout frames, relevant data, printed materials, or electronic documents, etc., are protected by copyright law, international copyright treaties and other intellectual property laws and regulations.

II. [Scope of Authorization for "Software"]

2.1 Users may install, use, display and run the Software on a single computer (hereinafter collectively referred to as "Computers").

2.2 Reserved Rights: All other rights not expressly authorized are still owned by MiMouse, and the user must obtain the written consent of MiMouse when using other rights.

2.3 Except as expressly provided in this Agreement, this Agreement does not stipulate relevant terms of service for other services accessed by MiMouse or its partners using this "Software", and there may be separate terms of service for these services, please understand and confirm separately when using the relevant services. If the user uses the service, it is deemed that the user accepts the relevant terms of service.

3. [Notice to Users]

3.1 The user shall ensure that the information provided by the user when registering the software or the services provided by the cooperative unit is true and correct.

3.2 MiMouse Account:

3.2.1 The ownership of the MiMouse account belongs to MiMouse, and the user obtains the right to use the MiMouse account after completing the registration application procedures.

3.2.2 The right to use the MiMouse account belongs to the initial registrant and is prohibited from being transferred, inherited or sold. If MiMouse finds that the user is not the initial registrant of the account, MiMouse has the right to reclaim the account without legal liability to the account user. MiMouse prohibits users from privately transferring their accounts for a fee or without compensation, so as to avoid disputes due to account problems, and users shall be responsible for any losses caused by violating this requirement.

3.2.3 The user is responsible for the custody of the MiMouse account and password, and is fully responsible for all activities under the account and password. The user must pay attention to the password protection of the MiMouse account.

3.2.4 If the user does not use the MiMouse account for a long time after registering it, MiMouse has the right to recycle the account to avoid waste of resources.

3.3 The User may use the Software in accordance with this Agreement on the premise of complying with the law and this Agreement. The user is not authorized to carry out any of the following acts, including but not limited to:

3.3.1 You shall not delete all copyright information and content on this "Software" and other copies;

3.3.2 The Software shall not be reverse engineered, disassembled, decompiled, etc.;

3.3.3 For the relevant information of the "Software", without the written consent of MiMouse, the user shall not carry out the following behaviors without authorization: use, copy, modify, link, reprint, compile, publish, publish, establish mirror sites, and develop derivative products, works, services, etc. related to the "Software" without authorization.

3.3.4 The user shall not use this "software" to publish, transmit, disseminate or store any content that violates national laws and regulations, endangers national security, national unity, and social stability, or any inappropriate, insulting, defamatory, obscene, or violent content.

3.3.5 The User shall not use the Software to publish, transmit, disseminate or store content that infringes on the intellectual property rights, trade secret rights and other legal rights of others.

3.3.6 The User shall not create a false identity to mislead or deceive others.

3.3.7 Transmit or disseminate files that otherwise enable the transmission of images, photographs, software or other material that are protected by intellectual property laws, including, by way of example (but not limited to), copyright or trademark laws (or rights of privacy or publicity), unless you own or control the rights thereto or have received all necessary consents.

3.3.8 Use any material or information that contains images or photographs obtained through the exploitation of the Software in a manner that infringes trademarks, copyrights, patents, trade secrets, or other proprietary rights of any party.

3.3.9 No one shall engage in any behavior that endangers the security of computer networks, including but not limited to: using unauthorized data or entering unauthorized servers/accounts; Entering the public computer network or other people's computer systems without permission and deleting, modifying, or adding stored information; Attempt to probe, scan, or test the weakness of the Software's systems or networks without permission, or to undermine network security; Attempt to interfere with or disrupt the normal operation of the "Software" system or website, deliberately spread malicious programs or viruses, and other behaviors that damage and interfere with the normal network information services; Forge TCP/IP packet names or partial names.

3.4 The use of this "software" must comply with the relevant national laws and policies, safeguard national interests, protect national security, and abide by this agreement, for all liabilities arising from the user's illegal or illegal use of this agreement, the user shall be fully responsible, and have nothing to do with MiMouse and its partners, resulting in the loss of MiMouse and its partners, MiMouse and its partners have the right to demand compensation from the user, and have the right to immediately stop providing services to them, keep relevant records, and reserve the right to cooperate with the judicial authorities to pursue legal responsibility.

3.5 The Software, like most Internet software, may be subject to various security issues, such as others using the user's information to cause real-life harassment; Other software downloaded and installed contains viruses such as "Trojan horses", which threaten the security of the user's computer information and data, and then affect the normal use of the "software". Users should strengthen their awareness of information security and the protection of user information, and pay attention to strengthening password protection to avoid loss and harassment.

3.6 Any other software derived from this "software" that is not developed and officially released without the authorization of MiMouse or MiMouse is illegal, and downloading, installing, and using such software may lead to unpredictable risks, and users are advised not to download, install, and use it easily, and all legal liabilities and disputes arising therefrom have nothing to do with MiMouse.

3.7 Minors should learn to use the Internet correctly under the guidance of their parents and teachers.

3.8 Respecting the privacy of user information resources is the consistent system of MiMouse, MiMouse will take reasonable measures to protect the user's information resources, except for legal or government requirements or user consent and other reasons, MiMouse will not disclose or disclose user information resources to third parties other than cooperative units without the consent of the user. However, unless the user chooses or agrees at the time of registration, or there is a separate agreement between the user, MiMouse and its partners on the disclosure or use of user information resources, and the user shall bear any risks that may arise therefrom, and MiMouse shall not be responsible for this.

3.8.1 Generally speaking, MiMouse needs to use the user's information resources for the following reasons: (1) to perform software verification services. (2) Perform software upgrade services. (3) To improve the security of your use and provide customer support. (4) When the user uses the specific functions of MiMouse, such as email login proxy service, etc., or because the user requires MiMouse or its partners to provide specific services, MiMouse or its partners need to provide the user's information to the third party associated with it. (5) Implement the "Privacy Protection Statement" of MiMouse, and the user can visit the MiMouse website to consult the statement. (6) Other behaviors that are beneficial to the interests of users and mice.

3.8.2 Consent and risk warning for the use of computer resources and the backup of personal network information resources

3.8.2.1 The MiMouse Software requires the User to jointly enjoy and maintain the benefits provided by MiMouse, and the User hereby acknowledges that the MiMouse Software may use your computer's processor and bandwidth as necessary for the limited purpose of allowing other users of the MiMouse Software to communicate with you and share the MiMouse Software and Services. This consent may affect the user's experience and bring unpredictable risks. You should carefully consider and make your choice, and you bear the risk.

3.8.2.2 If you need to use all the services and functions provided by MiMouse software, you may need to authorize MiMouse software to allow MiMouse software to use proxy to make necessary backups of some of your personal network information in other network services, and encrypt and store it on the MiMouse software server. MiMouse promises that the authorization for the user is limited to the user's own use, and will not cause conflicts and influences on other network services. You hereby confirm and agree to authorize the MiMouse software to back up your personal network information resources when necessary for the limited purpose of managing your personal network information and providing assistance to you in network communication. This consent may affect the agreement and relationship between you and other network service providers, and may bring unpredictable risks. You should carefully consider and make your choice, and you bear the risk.

3.8.2.3 You agree that MiMouse Software will use its reasonable efforts to protect the privacy and integrity of your computer resources, personal network information resources and computer communications, however, you acknowledge and agree that MiMouse cannot provide any guarantee in this regard.

3.8.3 The "User Consent" is provided in the following ways: (1) accepting this Agreement and the terms of service published by MiMouse; (2) Oral or written representations made by the user by e-mail, telephone, fax, Internet telephone, etc.; (3) There is a "tacit consent" clause in the agreement or service statement, and the user has no objection to it. (4) Other methods that are recognized by both MiMouse and the user.

3.8.4 MiMouse reserves the right to disclose any information at any time as required by applicable laws, regulations, legal process or government requirements, or to edit, refuse to post or delete any information or materials in whole or in part at MiMouse's sole discretion.

3.9 Replacement, modification and upgrade of the Software: MiMouse reserves the right to replace, modify and upgrade the version of the Software and charge a fee for the replacement, modification or upgrade by providing you with the Software at any time. The "software" is the default "upgrade prompt" function for the user, depending on the difference in the version of the "software" used by the user, MiMouse provides the user with the choice of whether to activate this function.

3.10 MiMouse and/or its partners will provide users with various network communication value-added services related to the "Software" according to the development of the market and technology, including free and paid value-added services. MiMouse and/or its partners reserve the right to charge fees for relevant value-added services and change the charging standards and methods; If the relevant service is changed from free to paid service, MiMouse and/or the partner will notify in an appropriate form, and the user can choose to accept or refuse the paid service independently, and guarantee that when using the paid service, the fee will be paid in accordance with the relevant charging regulations of MiMouse and/or the partner, and if the fee is refused or the fee is in arrears, MiMouse and/or the partner has the right to stop the service and recover losses and compensation according to law.

3.11 Through the services of the Software, you may connect to third-party websites, software and web services (hereinafter referred to as "Links"). We provide these Links to you as a convenience, but we do not control and are not responsible for third-party Links and Services. If you have a transaction with the corresponding third-party sites and services because of this, you shall bear all responsibilities, and MiMouse shall not assume any responsibility. If you suffer any troubles and losses due to third-party services, you need to directly negotiate with the corresponding third-party service provider to solve the problem, and MiMouse does not assume any responsibility.

4. [Legal Liability and Exemption]

4.1 License to Use

4.1.1 License to Use Your Computer: In order to obtain the benefits provided by the MiMouse Software, you hereby grant MiMouse permission to use your computer's processor and bandwidth for the limited purpose of allowing other users of the MiMouse Software to communicate with you.

4.1.2 Protecting Your Computer (Resources): You acknowledge that MiMouse will use commercially reasonable efforts to protect the privacy and integrity of your computer resources and computer communications, however, you acknowledge and agree that MiMouse cannot provide any warranty in this regard.

4.2 MiMouse reminds users that in order to protect the company's autonomy in business development and adjustment, MiMouse has the right to modify or interrupt the software authorization at any time without notifying the user, and if necessary, the modification or interruption will be announced on the important page of the MiMouse service website in the form of notice.

4.3 Any claim, demand, or loss, including reasonable attorneys' fees, asserted by any third party that may result from or arise from the User's violation of the provisions of this Agreement or the relevant Terms of Service. You agree to indemnify and hold harmless Mitouse, its affiliates, and affiliates. In this regard, MiMouse has the right to take measures including but not limited to interrupting the use license, stopping the provision of services, restricting the use, recovering the user's MiMouse account, and legal prosecution depending on the nature of the user's behavior. The Company reserves the right to reclaim the MiMouse account for illegal activities, disruption, harassment, or deception of other users. At the same time, MiMouse will assist in the investigation as required by the judicial authorities.

4.4 The use of this "software" is at the user's own risk, and MiMouse and its partners do not make any kind of guarantee for this "software", whether express, implied or statutory warranties and conditions, including but not limited to the express or implied warranties and conditions of merchantability, suitability, no virus, no negligence or no technical defects, ownership, beneficiary rights, and non-infringement of this "software", and for any direct, indirect, incidental, For special and subsequent damages and risks, MiMouse and its partners do not assume any responsibility.

4.5 The use of this "Software" involves Internet services, which may be affected by unstable factors in all links, and there is a risk of service interruption or failure to meet the user's requirements due to force majeure, computer virus, hacker attack, system instability, the user's location, the user's shutdown and any other network, technology, communication lines, etc., the user must understand and bear the above risks, and the user cannot send or accept the reading message, or receive or send the wrong message, and MiMouse and its partners do not assume any responsibility.

4.6 The use of this "software" may have the risk of anonymous or impersonated information containing threatening, defamatory, offensive or illegal content from others, and the user must understand and bear the above risks, and MiMouse and its partners shall not be responsible for the authenticity, applicability and legality of any relevant information.

4.7 The user shall not be liable for the economic losses suffered by the user due to the communication line failure, technical problems, network, computer failure, system instability and other force majeure reasons of the third party, such as the telecommunications department.

4.8 If the normal operation of the service is affected by force majeure events such as technical failures, MiMouse and its partners promise to cooperate with relevant units in the first time to deal with and repair them in a timely manner, but MiMouse and its partners shall not be liable for the economic losses suffered by users.

4.9 Any psychological and physical harm and economic losses caused or may result from misleading or deception between users and other users through this "software" shall be borne by the party at fault according to law, and shall have nothing to do with MiMouse and its partners.

5. [Miscellaneous]

5.1 If any provision of this Agreement is partially or wholly invalid, it shall not affect the validity of the other provisions.

5.2 The interpretation, validity and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. If any dispute or controversy arises between the user and MiMouse, it shall first be settled through friendly negotiation, and if the negotiation fails, the user hereby fully agrees to submit the dispute or controversy to the jurisdiction of the court where MiMouse is located.
